1. Introduction
These Terms of Use (together with any referenced documents) govern your access to and use of the website www.ivryclean.com and related booking and communication platforms operated by IVRY Clean, based in Texas. By using our services or website, you agree to these terms. If you do not agree, you must not use our services.
2. Other Applicable Terms
These terms incorporate our Privacy and Cookie Policy, which describes how we collect, use, and protect your personal information. By using IVRY Clean, you consent to our data handling practices.
3. Information About IVRY
IVRY Clean operates as a platform connecting customers with independently contracted service providers (cleaners). We do not directly perform cleaning services. Any service agreements are between the customer and the service provider.
4. Disclaimer
We act solely as a facilitator between you and independent cleaners. IVRY Clean is not responsible for service quality or actions of service providers. All agreements and liabilities lie between the user and the assigned cleaner. In case of disputes, we may offer mediation but do not guarantee resolution.
5. Account Use
You are responsible for maintaining the confidentiality of your IVRY account login. We may suspend access if there is a breach or misuse of services.
6. Pricing and Payment
Service prices are displayed at booking. Payment is processed after services are rendered. We reserve the right to place a pre-authorization hold on your card prior to the service. If a card is declined, you must provide an alternative or risk cancellation. Unpaid amounts may accrue interest and administrative fees, and may result in account suspension.
7. User Responsibilities
You must provide a safe and accessible work environment. If service cannot be completed due to access, utilities, or parking issues, you may be charged the full booking fee. You agree not to solicit or hire cleaners outside the IVRY platform for 6 months after your last booking.
8. Booking & Cancellation
Bookings must be cancelled or rescheduled at least 48 hours in advance to avoid charges. Bookings made within 48 hours of the scheduled time may be subject to full fees if cancelled.
9. Service Providers
All IVRY cleaners are independent contractors. You agree not to solicit their services outside of our platform. If you breach this policy, your account may be terminated, and you may be charged up to $500 in damages.
10. Dispute Resolution
Contact support@ivryclean.com for any service-related issues. Deep cleans or move-out cleans may qualify for a free re-clean if reported within 48 hours with photos. Carpet cleaning services are not covered by re-clean guarantees.
11. Insurance
Service providers are expected to maintain liability insurance. For damages exceeding $300, IVRY may help facilitate communication with the provider’s insurer. Claims must be reported to support@ivryclean.com within 48 hours and include photo evidence.
12. Suspension & Termination
We reserve the right to suspend or terminate your access to IVRY Clean at our discretion. All rights granted under these terms will cease immediately upon termination.
13. Events Outside Our Control
We are not liable for delays or service failures caused by events outside our reasonable control, including internet outages, severe weather, or public emergencies.
14. Additional Terms
We may transfer our rights under these terms without affecting your rights. You may not transfer your rights without written consent. Each clause of these terms operates separately. If any are found unenforceable, the rest remain in effect.
15. Applicable Law
These Terms of Use, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
If you are a consumer, you agree that any legal proceedings arising from or related to these Terms may be brought in the state or federal courts located in Harris County, Texas, and you consent to the jurisdiction of those courts. However, this does not affect any rights you may have under applicable consumer protection laws in your state of residence.
If you are a business, you and IVRY agree that the courts of Harris County, Texas shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation. Nothing in this section shall limit our right to bring proceedings against you in any other court of competent jurisdiction, nor shall bringing proceedings in one or more jurisdictions prevent us from bringing proceedings in another jurisdiction, whether concurrently or not, to the extent permitted by applicable law.
